No members of the public were present.

 

153 Apologies for absence

Apologies were received from Mr J Alexander.

 

154 Declarations of Interest

Members were reminded that they must declare any personal or prejudicial personal interests in any items of business on the meeting’s agenda.

 

155 Minutes

RESOLVED: that the minutes of the meeting held on 6th November 2006 be approved and signed as a correct record.  There were no matters arising.

 

156 CBC Planning applications and decisions

Applications were considered and responses agreed.  Planning decisions were noted, including the refusal of permission for the change of use of Unit 2, 72 Maldon Road, to a takeaway business (06/01914/FUL).

RESOLVED:

a) that the responses to planning applications shown in Appendix A be submitted to Chelmsford Borough Council, and that none of the these applications need be referred to the local Ward Members;

b) that the planning decisions shown in Appendix B be noted.

 

157 Appeals against refusal of planning permission

Appeals had been lodged in relation to 06/00987/FUL (2 Simmonds Way: erection of fence) and 06/01146/FUL (land rear of Airlie, Riffhams Lane: erection of 3 detached dwellings).  The Committee noted that its previous comments to CBC would be taken into account by the Planning Inspectorate, and considered whether to submit any further comments.

RESOLVED: that no additional comments be made, and that copies of the decision notices be requested.

 

158 CBC Planning Committee

It was noted that the agenda for the meeting on Tuesday 21st November 2006 did not include any items relating to Danbury.

   

159 Work to trees

One application had been received for work to trees and was considered.  No decisions had been received.

RESOLVED: That no comment be made on the application for work to trees in the Conservation Area shown in Appendix C.

 

160 CBC Local Development Framework - Planning consultations

The following CBC consultations had been received:

·  Core Strategy and Development Control Policies Development Policy Document

·  Chelmsford Town Centre Area Action Plan Development Policy Document

·  Affordable Housing Supplementary Planning Document

·  Urban Design Supplementary Planning Document

·  Sustainable Design and Construction Supplementary Planning Document

As the consultations closed on 19th December 2006, comments would need to be agreed at the next meeting of the Committee on 4th December.  The documents were available in the Parish Office (some on disk) and could also be viewed on the CBC website at http://www.chelmsford.gov.uk.

RESOLVED: that members examine the consultation documents and bring their comments to the 4th December meeting.

 

161 Danbury Planning Framework

The Chairman reported that a meeting with Derek Stebbing of CBC had taken place on Wednesday 15th November.  Mr Stebbing did not wish to make any changes to the content of the Planning Framework and had complimented the Parish Council on the high quality of the document.  In order for the Framework to be considered by CBC Cabinet for approval as a supplementary planning document, a sustainability appraisal must be carried out by an independent company.  Mr Stebbing undertook to make enquiries with a company used by the Borough Council.  The cost was likely to be several hundred pounds.

RESOLVED: that Parish Council be asked to agree the expenditure of up to a maximum of £1000 from the Parish Plan budget to carry out a sustainability appraisal for the Danbury Planning Framework.

Members noted that it was likely to be late summer or early autumn 2007 before the Planning Framework could be published.

 

162 Digital Projector

It was reported that a number of Councillors and staff had been present at the demonstration of a Nobo projector at the Parish Office on 15th November.  Architectural drawings and other planning items downloaded from the CBC website had been viewed via the laptop computer, and members had been pleased with the quality of the images and ease of use.  The proposal to suspend the projector from the ceiling was being reconsidered in view of the likely cost and on security grounds.

Resources Committee would now be asked to approve the purchase of a projector, screen, remote control and other associated items.

The information was noted.

 

163 Planning Familiarisation Day October 2006: Follow-up

Members noted that letters of thanks had been sent to the CBC officers who contributed to the day.  CBC had been asked to suggest dates early next year for members to spend a few hours shadowing a planning officer.  A response was awaited.

 

164 Stopping up of Highway – 32 Runsell Lane (06/01179/FUL)

The Committee noted that, following approval of this planning application (on which the Parish Council made no comments) for change of use to a residential garden, the Secretary of State for Transport had made an Order for the stopping up of the highway.  This had been displayed in the village for the statutory period to allow for objections to be raised.

 

165 Correspondence

No items had been received.

 

166 Enforcement

a) Bakers Arms pizza sign: The landlord had submitted a planning application for the sign.  The application was invalid for a number of reasons and he had been asked by CBC to resubmit it.

b) Poplar Farm, access and metal gates: CBC had given the owner until 8th December to submit a retrospective planning application

c) Bakers Arms entertainment licence: Cllr Berlyn reported that music had on occasions been played in the pub garden until 1am.  The Committee agreed that the terms of the entertainment licence should be investigated.

 

167 Matters for report (for information only)

Purleigh, Penny Royal Road (06/00695/FUL): The scale of work being carried out at the site was commented on, and it was noted that the Parish Council had objected to the application.  The Committee agreed to look again at the site when work was completed as part of its planned feedback to CBC.

4 We note that a 24 hour service is offered.  Will this result in traffic movements 24 hours a day which would be to the detriment of the local residents and the area generally?

The Parish Council opposes the application for the following reasons:

1 Increase in traffic congestion on the approach to the garage

2 Noise from patrons and vehicles;

3 Litter and waste food being discarded by people walking the nearby roads;

4 The establishment would act as a meeting point with the attendant problems of noise, litter and smell compounding the current problems from existing outlets.

If the Council is minded to approve the application, we request that the following conditions are applied:

1 Prohibit use of fruit and entertainment machines and music sources;

2 Specifically prohibit Sunday trading;

3 Impose opening hours as in the Access Statement, ie 11am to 10pm, Monday to Friday;

4 Ensure that fire and health and safety regulations are complied with regarding the increased fire risk;

5 Require an appropriate filtering system to prevent smells escaping the premises.
