Minutes of the Meeting held on 9 October 2006 at 8.00pm in the Parish Office

Public Question Time

Four members of the public attended and presented their objections to the application for change of use to a takeaway at Unit 2, Stratford House, Maldon Road.  Their objections included parking problems, the likely increase in youth nuisance and litter, and the view that there was no need for an additional food outlet in the village.

 

115 Apologies for absence

Apologies were received from Mr J Alexander.

 

116 Declarations of Interest

Members were reminded that they must declare any personal or prejudicial personal interests in any items of business on the meeting’s agenda.  Cllr Telling declared a general interest in the application relating to Stratford House, Maldon Road, by virtue of the fact that members of his family lived nearby.

 

117 Minutes

RESOLVED: that the minutes of the meeting held on 25th September 2006 be approved and signed as a correct record.

 

118 CBC Planning applications and decisions

Applications were considered and responses agreed.  At the appropriate times representations from residents were taken into account in relation to the applications at Unit 2, Stratford House and the Telecommunications tower in Little Baddow Road

In the discussion of application 06/01914/FUL – Change of use to A5 (Takeaway) with addition of access ramp and alterations – at Unit 2, Stratford House, members expressed differing views.  Some members supported the application on the grounds that it would appeal to a wide number of residents and was different from other food outlets in the village.  Others opposed the application, believing that a takeaway would increase litter and nuisance and lead to congestion on surrounding roads.

The matter was put to a vote, and Cllr Wood requested that the vote be recorded.  Voting on the proposal to support the application was as follows:

In favour: Cllrs Berlyn, Keeler and Thomson.

Against: Cllrs Allen, Telling and Wood.

The voting being equal, the Chairman used his casting vote against the application.  The motion was therefore lost.  In composing its response to CBC, the Committee therefore opposed the application, but also requested the imposition of a number of conditions should be application be approved.

RESOLVED:

a) that the responses to planning applications shown in Appendix A be submitted to Chelmsford Borough Council;

b) that applications 06/01870/TELFUL and 06/01872/TELFUL (Telecommunications tower, Little Baddow Road) be referred to the local Ward Members, and that CBC be requested to confirm that, in accordance with an earlier decision of the Borough’s Planning Committee, these applications would be determined by the Committee rather than under delegated powers;

b) that the planning decisions shown in Appendix B be noted.

 

119 Planning Appeal - ECC

Brett Concrete Ltd had appealed against ECC’s refusal of its application relating to Sandon Quarry: ESS/49/05/CHL “Retention of existing batching plant in mothballed state of unuse until 31 December 2009”.  The Parish Council made no comments at its meeting on 5 December 2005.

RESOLVED: That the Committee did not wish to send any comments to the Planning Inspectorate in this case.

 

120 CBC Planning Committee

The agenda for the meeting on Tuesday 10th October did not include any items relating to Danbury.

 

121 Work to trees

RESOLVED:

a) that the Committee did not wish to make any comments the application for work to trees shown in Appendix C;

b) that the decision on work to trees shown in Appendix C be noted;

 

122 Danbury Planning Framework

Further progress would be reported after the Chairman’s meeting with Derek Stebbing at CBC on 18th October.

 

123 Correspondence

The next forum for Parish Councils at Chelmsford Borough Council would be held on Wednesday 22nd November 2006, commencing at 7pm in the Council Chamber.  Details had been circulated.  Cllrs Allen, Berlyn and Keeler expressed an interest in attending.

A resident had copied to the Council his email to Town Planning objecting to application 06/01748/TELFUL for the installation of an additional dish on the water tower telecommunications tower.  The Committee had already submitted its comments to CBC.

 

124 Enforcement

a) Bergen, Southview Road (04/02166/FUL): CBC had registered the enquiry and were investigating;

b) Poplar Farm, Gay Bowers Road: CBC was already investigating the gates and access road and the owner had been invited to meet with officers;

c) Bakers Arms – advertising sign: CBC had registered the enquiry and were investigating;

d) Purleigh, Penny Royal Road: The Chairman reported that ECC Highways appeared to have taken action as the illegal occupation of the road by the builders had ceased.

 

125 Matters for report (for information only)

There would be a demonstration of a digital projector for Planning Committee purposes at 11am on Wednesday 8th November in the Parish Office.  All members of the Committee were welcome to attend.

4 The visual impact of the tower detracts from the acknowledged Regional significance of Danbury Ridge (policy DS1).

The Parish Council opposes the application for the following reasons:
1 Increase in traffic congestion on the approach to the garage
2 Noise from patrons and vehicles;
3 Litter and waste food being discarded by people walking the nearby roads;
4 The establishment would act as a meeting point with the attendant problems of noise, litter and smell compounding the current problems from existing outlets.
If the Council is minded to approve the application, we request that the following conditions are applied:
1 Prohibit use of fruit and entertainment machines and music sources;
2 Specifically prohibit Sunday trading;
3 Impose opening hours as in the Access Statement, ie 11am to 10pm, Monday to Friday;
4 Ensure that fire and health and safety regulations are complied with regarding the increased fire risk;
5 Require an appropriate filtering system to prevent smells escaping the premises.
