for absence
Apologies were received and accepted from Cllr S Berlyn.
101 Declarations of Interest
Members were reminded that they
must declare any personal or prejudicial personal interests in any items of business
on the meeting’s agenda. Cllr Thomson
declared a personal interest in agenda item 11 (minute110) by virtue of being friends
with the owners of the house he believed might be the one in question.

Minutes of 4th September 2006
Two amendments were made to the minutes as follows: i) Under Public Question Time, para 3, the words “The Agent stated that” were added at the beginning of the sentence “...There were 41 letters of support for the application and 9 letters against….” ii) Under minute 88a, the words “to Borough Councillors unless Officers were minded to refuse it” were added after “…be referred.” RESOLVED: that, with the amendments above, the minutes of the meeting held on 4th September 2006 be approved and signed as a correct record.

CBC Planning applications and decisions
Six applications were considered and responses agreed. At the appropriate time a letter from residents at 13 Parkdale to CBC objecting to proposal at 5 Mildmays was noted. RESOLVED: a) that the responses to planning applications shown in Appendix A be submitted to Chelmsford Borough Council; b) that none of the applications need be referred to Borough Councillors for determination by CBC Planning Committee; c) that the planning decisions shown in Appendix B be noted.

CBC Planning Committee
Meeting of 19th September 2006: Members noted that application 06/01146/FUL (new houses on land rear of Airlie, Riffhams Lane) had been refused planning permission. The Chairman, who attended the meeting, gave a brief report.
105 Work to trees The Committee RESOLVED: a) that it did not wish to make comments on any of the four applications for work to trees protected by a TPO (Appendix C); b) that the decision shown in Appendix C be noted.

Records Retention Policy
This matter had been referred to Planning by Resources Committee. Members noted that the Borough Council’s policy was to keep paper records for 5 years and electronic records indefinitely. The current practice for the Parish Council’s planning records, including plans, was to retain them for 5 years. Members felt that this practice should continue, and that when the Parish Council began to hold application details electronically these records should be kept indefinitely. RESOLVED: that Resources Committee be informed that paper records of planning applications, including plans, should continue to be retained for 5 years.

CBC Development Policy Committee – 20th September 2006
The Committee noted that the meeting planned for 6th September had been cancelled and that the business was taken to the above meeting, including pre-consultation approval of the draft supplementary planning documents on Affordable Housing, Sustainable Design and Construction and Urban Site Design.

East of England Plan: Provision of Gypsy and traveller Caravan sites
The Committee noted that the Statement of Public Participation for the forthcoming single issue review on the provision of these sites included consultation with Parish Councils. Comment had been invited by 11th October. RESOLVED: that a response be sent indicating that the Council was glad to see that Parish Councils would be consulted in connection with the review and looked forward to receiving further documents in due course.

The Chairman reported that he would be meeting with Derek Stebbing to discuss the final draft framework on 18th October.
110 Correspondence
The following items were received and noted: a) Letter from a resident to CBC regarding the pre-application consultation conducted by Arqiva on proposals for Bakers Lane tower (minute 61 of 17th July 2006 refers); b) Letters from the Danbury Society to CBC and from a resident objecting to the proposed development at Riffhams Farm (06/01650FUL)

Mr Alexander reported that modifications had been carried out to the light he had been concerned about (minute 98) and it was no longer a problem.

Enforcement
a) Bergen, Southview Road: (04/02166/FUL) The Chairman reported that the extension being built on this property appeared to deviate from the approved plans in that the new roof was hipped rather than gabled. While this might be considered an improvement aesthetically, he was concerned that the change might have been made without approval from the planning authority. The Committee agreed that the matter be raised with CBC. b) The Sanctuary (06/00149/CLEUD): Members noted the reasons for approval of the application as shown in the officer’s report; c) Purleigh, Penny Royal Road: The Chairman reported that the builders at Purleigh had temporarily coned off part of the road and footpath causing a traffic and pedestrian hazard. This had been reported to ECC Highways who had indicated that they would take action against the illegal occupation of the highway; d) Poplar Farm, Gay Bowers Road: Gates had been installed where there was originally a farm gate. It was agreed that the issue be raised with CBC in case planning permission was required; e) Notice at the Bakers Arms: A sign advertising take-away pizza had been attached to the front of the public house. The Committee noted that the site was within the conservation area, and agreed that CBC be consulted regarding the need for planning approval.
113 Matters for report Cllr Telling reported that Silk Racing, the company interested in the former Unwins shop in Maldon Road, had opened a second outlet in Maldon, this time near the High Street; Cllr Keeler reported that Essex & Suffolk Water had resolved the water leak issues in Fitzwalter Lane and also flooding relating to a stream; Cllr Allen reported on an unsolicited phone call he had received, apparently relating to a proposal to open a home improvement business in the building which was currently Danbury Library. County Cllr Peter Martin would be approached to see whether there was any further official information regarding the future of the County Council’s buildings in Danbury.
