Members agreed that Public Question Time should be taken prior to the Planning Applications.

 

Public Question Time

 

85 Apologies for absence

Apologies were received and accepted from Philip Watts.

 

86 Declarations of Interest

Cllr John Thomson declared an interest in the application for 41 Maldon Road by virtue of being friends with the applicants.

Cllrs Allen, Berlyn, Keeler, Thomson, Telling and Wood  declared a general interest in Planning Application for Riffhams Farm by virtue of one of the applicants being a Parish Councillor.  

 

87 Minutes of last meeting

RESOLVED: that the minutes of the meeting held on 17th July 2006 be approved and signed as a correct record.  There were no matters arising.

 

Public Question Time

The Applicant spoke regarding Graces Farm application and explained that a further application on the site had been suggested by Chelmsford Borough Council as it would enhance the location and benefit the traffic movements in the area.   The proposal was for a single dwelling on the site and smaller than previous applications.  The Applicant explained that visits from the Enforcement Section of the Borough Council occurred regularly.  Concerns had been raised by residents regarding the Operators Licence.  41 letters of support for the application had been received.

 

Six Members of the Public spoke regarding Graces Farm.  One Member of the Public quoted from Danbury Parish Council Action Plan and stated that the Parish Council would use all its powers to main and preserve the green character and open appearance of the village and to ensure the village envelope is not increased.  The following were comments made by other members of the Public.  The Planning Regulations should not be altered and no further applications should be made on the site.  It would spoil the countryside and the wildlife.  At present there is only one regular user to the site and the site would become more busy.  The site should be left as it is.  This area has been a special area for over 56 years and the Natural History of the site should be protected. Residents care about the village.  There would be pressure for urbanisation of the area.   The large 4 bedroomed site was against planning law.

 

The Applicants Agent then spoke regarding Graces Farm application.  The Planning Policy has to consider material considerations.  The house was less wide than before.  The Wider area of the landscape had been taken into account.   There had been some ambiguity and lack of consistency regarding complaints regarding lorries at the site.  The Agent stated that there were 41 letters of support for the application and 9 letters against the application.  There would be a net environmental benefit to the site.

 

The Chairman of the Parish Council raised with the applicant the process regarding the initiation of a further planning application.  The applicant then stated that he had contacted Chelmsford Borough Council and a formal reply was then received.  

 

88 CBC Planning applications and decisions

Six new applications were considered. 

RESOLVED:

a) that the responses to planning applications shown in Appendix A be submitted to Chelmsford Borough Council, and that Riffhams Farm Application 06/01650/FUL be referred to Borough Councillors unless Officers were minded to refuse it;

b) that the planning decisions shown in Appendix B be noted.

 

89 CBC Planning Committee

Meeting of 29th August, 2006  The Borough Council Committee was minded to refuse application 06/01146?FUL ( new houses on land rear of Airlie, Riffhams Lane).  A final decision was deferred to the next meeting for Officers to prepare a sustainable case for refusal.  Mr Thomson had attended the meeting on behalf of the Parish Council.  The next meeting of the Borough Council Committee was Tuesday 19th September, 2006.

 

RESOLVED: that the information be noted.

 

90  Consultation by K J Sims Holding Ltd: Change of Use at Stratford House

The Owner of Stratford House had written to the Parish Council regarding alternative uses for the former Unwins property.  Members of the Committee considered a response. 

 

Members felt that the Planning Committee were unable to comment on what the outlet should be used for.  The Committee were pleased that a retail outlet was being considered.

 

RESOLVED:  that the Clerk replies to the owner of Stratford House welcoming that the different alternative uses for the outlet were being explored but that the impact on the local area and residents must be paramount in the decision making process.

 

91  Work to Trees

91.1 Members noted applications for work on trees as in Appendix C

 

92   Records Retention Policy (Freedom of Information Act)

This item was deferred to the next meeting.

 

93  East of England Plan

 

93.1 Panel Report following examination in Public

A letter from the Secretary of State had been circulated together with a briefing note on key panel recommendations.

 

Cllr Thomson requested that the Parish Council write again reiterating the top three concerns.

 

RESOLVED: that a) the documents be noted.

b) The Clerk write again reiterating the top three concerns.

 

93.2 Provision of Gypsy and traveller Caravan Sites

Parish Councils were to be included as a statutory consultees.  The closing date for comments will be Wednesday 11th October, 2006.

This item was deferred until the next Agend a.

 

94  CBC Development Policy Committee – 6th September, 2006

Draft Documents were available for consultation for three supplementary planning documents for public consultation on Affordable Housing, Sustainable Design and Construction and Urban Site Design.  The draft documents were available at the meeting and it was decided to pass the documents through the planning committee.

 

RESOLVED: that the Clerk circulate the documents round the Planning Committee.

 

95  Danbury Planning Framework

The Chairman had contacted the Borough Council representative  but was still awaiting a reply.

RESOLVED: that the Borough Council representative be contacted again.

 

96  Correspondence

No further items of correspondence had been received.

 

97 Enforcement

97.1 Tennis Courts – Lighting (98/0608/FUL)            

A resident had written claiming that the Tennis Club had failed to comply with the terms of planning approval for the lighting on the (southern) courts.  Copies of the letter and planning decision were circulated with the agend a.   An enquiry had been sent to the Tennis Club Chairman and was awaiting response.

 

RESOLVED:  that this item also be taken to Facilities Committee to give a chance for the Tennis Club to reply.

 

97.2  Fly-posting for Caravan Site

Chelmsford Borough Council had written again to the company threatening prosecution.  Members discussed the matter and stated that they had seen no further notices for the last two weekends. It was thought that this could be a seasonal advertisement and that the season was coming to an end.

 

RESOLVED:  that the Clerk wait for another two weeks and see if the notices return.

 

97.3 The Sanctuary (06/0014)CLEUD)

The Clerk was still awaiting a response.

 

98 Matters for report (for information only)

John Alexander was concerned regarding  a dazzling light near the 40 mph sign before the first bend. 

RESOLVED:  that Members try to take note of the light and report to next meeting.

 

99 Forthcoming meetings – Autumn 2006

6th and 20th November; 4th and 18th December

The Parish Council strongly objects to the proposal to include multiple lanterns and brick light illumination to the street side of the wall, which is unwanted, the area is well lit and the lighting proposal is unjustified in close proximity to the conservation area. The proposal will add significantly to light pollution.  The lanterns are 550 mm which will add significantly to the overall height of the finished wall.
