for absence
Apologies were received and accepted from Cllr A Allen.
70 Declarations of Interest
Members were reminded that they must declare any personal or
prejudicial personal interests in any items of business on the meeting’s
agenda. No declarations were made.

Minutes of last meeting
RESOLVED: that the minutes of the meeting held on 17th July 2006 be approved and signed as a correct record. There were no matters arising.

CBC Planning applications and decisions
Five new applications were considered. The Committee agreed to include the application at Little Bell Hill, Bakers Lane (06/01941/FUL), received too late for inclusion in the agenda, as otherwise the deadline for comments would be missed. The Committee also looked at amendments to application 06/01146/FUL (land rear of Airlie, Riffhams Lane) which had not been sent to the Parish Council for comment at the appropriate time. RESOLVED: a) that the responses to planning applications shown in Appendix A be submitted to Chelmsford Borough Council, and that none of these applications need be referred to the local Ward Members; b) that CBC be informed of the Council’s concern that it had not been given the opportunity to comment on the amendments to application 06/01146/FUL at the appropriate time; c) that the planning decisions shown in Appendix B be noted, and that CBC be asked for information about the legal grounds on which 06/00149/CLEUD (The Sanctuary, Southwood Chase) had been permitted.

CBC Planning Committee
The agenda for the meeting to be held on Tuesday 8th August 2006 included two applications to which the Parish Council had raised objections. These were 06/01146/FUL (rear of Airlie) and 06/01060 (Betting shop, Unit 2, Stratford House). Cllr Telling would be attending the meeting to represent the Council.

Planning applications: Site Notices
The response from CBC to the Committee’s enquiry regarding assisting with the posting of site notices was noted. RESOLVED: that the letter be acknowledged with thanks, and that details be provided, if possible, of instances where residents were unaware of planning applications because of the lack of a site notice.

Essex & Suffolk Water – new mains (minute 55 refers)
Information had been received from Essex & Suffolk Water that the pipe-laying reported by Cllr Keeler was for the bulk transfer of water from treatment works at Layer de la Haye. The pipe connected with Hanningfield Reservoir and would eventually end at Herongate, near Brentwood. It was understood that there were no immediate plans to take the pipe any further than the current Butts Lane (Sandon) stopping point. E&S Water had confirmed that they did consult with local councils through their agents, Savilles, and that Danbury PC would be approached when the plans for the next section of the pipe reached the consultation stage. In view of the existing pipes under Sporhams Lane, it was likely that an alternative route would be sought. The information was noted.

Freedom of Information Act - Records Retention Policy
At the request of the Resources Committee (19th July 2006), the Committee reviewed its practice as regarded the retention of the plans accompanying planning applications. Members noted that it was considered good practice to retain documents only for as long as required. There was no recommended or statutory period for retaining plans and planning applications. Current practice was to retain plans until after the approved deadline for the commencement of work – previously 5 years from approval, now 3 years. Plans had been retained in the Parish Office since October 2001 (previously they were returned to CBC) and therefore no plans had yet been discarded. Members felt it would be helpful in determining a policy to know how long plans and other information, including online information, would continue to be available at CBC for consultation by the Parish Council. RESOLVED: that CBC
Town Planning be consulted regarding their retention policy for plans and
planning applications and for the online planning system, and that the question
of a Parish Council policy be looked at again in the light of the information
received.
80 Correspondence
Lynne Foster, Operations Director at Chelmer Housing Partnership, had written regarding CBC’s proposed lettings policy for the redeveloped houses in Mill Lane and CHP’s support for a ‘local connection’ to be part of the policy. The information was noted. Members agreed that as this was no longer a planning issue it would be appropriate for the Environment Committee to take the matter further. RESOLVED: that Ms Foster’s letter be acknowledged with thanks, and that the information be referred to the Environment Committee for action.

Enforcement
a) Fly posting for caravan site: CBC had reopened the case and would again write threatening prosecution. Digital photographs of the offending signs would be helpful; b) 146 Main Road: A full response had been received from the Director of Planning & Building Control at CBC regarding enforcement issues at this property. The letter was noted, including the fact that a planning application was needed for the wall, which was currently over 1 metre in height.
