Minutes of the Meeting held on 17 July 2006 at 8.00pm in the Parish Office

Public Question Time

Mr D Winter was present regarding the application for change of use at Unit 2, Stratford House, to a betting office, which would be considered by CBC Planning Committee on 8th August.  The Chairman and Vice-Chairman explained the procedures under which members of the public could address the Committee, and confirmed that the Parish Council would be represented at the meeting.

 

57 Apologies for absence

Apologies were received and accepted from Mr J Alexander and Cllr S Berlyn.

 

58 Declarations of Interest

Members were reminded that they must declare any personal or prejudicial personal interests in any items of business on the meeting’s agenda.  No declarations were made.

 

59 Minutes

RESOLVED: that the minutes of the meeting held on 3rd July 2006 be approved and signed.

Minute 55: Essex & Suffolk Water had been in touch following the Parish Council’s enquiry about work being carried out near Danbury.  More information should be available by the next meeting.

 

60 CBC Planning applications and decisions

Three planning applications were considered and responses agreed.  At the appropriate time a letter from Messrs Church & Hawes in support of application 06/01307/TELFUL (additional antennas, Water Tower mast) was noted.

RESOLVED:

a) that the responses to planning applications shown in Appendix A be submitted to Chelmsford Borough Council, and that none of the the applications need be referred to local Ward Members;

b) that the planning decisions shown in Appendix B be noted.

 

61 Bakers Lane Mast: Pre-application consultation by Arqiva

The Committee discussed a letter from the Agent for the company Arqiva regarding Arquiva’s intention to submit a planning application to vary the condition of previous approval 05/00718/FUL to allow the installation of 4 further dish antennas for the mobile phone company ‘3’.  The proposal would exceed the permitted maximum number of antennas by 4 and the permitted maximum number of dish antennas by 2.  A letter from a resident, Mr A Hill, sent in response to the consultation, was noted.

RESOLVED: that Arquiva be informed that the Parish Council would strongly oppose any increase in the permitted number of antennas.  The company’s attention would also be drawn to the proximity of the Busy Bees Pre-school, which was not mentioned in the letter.

 

62 CBC Planning Committee

a) The agenda for the meeting on Tuesday 18th July was noted (no items relating to Danbury).

b) 06/01146/FUL: Rear of Airlie, Riffhams Lane (Three houses and access): This application was expected to be on the agenda for the CBC meeting on Tuesday 8th August 2006.  Cllr Telling would attend on behalf of the Parish Council;

c) 06/01060/FUL: Unit 2, Stratford House, Maldon Road (Change of use to Betting Shop): Cllr Kingsley had arranged for this application to be determined by the CBC Planning Committee “in view of the strength of local objection”, and it would be considered at the meeting on 8th August.

 

63 Danbury Planning Framework

The Chairman reported that, due to Derek Stebbing’s heavy involvement with the Local Development Framework, it was unlikely now that his comments on Danbury’s revised Planning Framework would be ready until September.

 

64 Work to trees

RESOLVED: that the Committee did not wish to make any comments on the application for work to trees in the Conservation Area shown in Appendix C;

b) That the decisions shown in Appendix C be noted.

 

65 Correspondence

a) Airlie, Riffhams Lane (06/01146FUL): A further three residents had supplied copies of their letters to Town Planning objecting to this application;

b) 10 Hyde Lane (06/01196/FUL): Miss Mary Parker had sent a copy of her letter to Town Planning objecting to the proposal for three houses in place of the existing one.

 

66 Enforcement

a) 146 Main Road – infringements of planning permission: The CBC Enforcement officer on this case had indicated that he did not intend to take any action against the owner, though he was continuing to monitor developments.  The Committee was unhappy with this response.

RESOLVED: that details of the case be sent to David Green, Director of Planning & Development Control, with a request that the matter be investigated further, and that a copy of the letter be sent to Cllr Ian Wright, Chairman of CBC Planning Committee.

b) Fly-posting for caravan site: The posting of the red signs was continuing at weekends.  The Committee agreed that CBC be asked to take enforcement action, as the threat of prosecution had not had the desired effect;

c) Cars parked in Well Lane: ECC Highways had noted at a site visit that three vehicles were parked on the verge and were untaxed.  Action would be taken either by ECC or DVLA to ensure that the vehicles were removed;

d) Advertising signs – flower seller on the A414 near to A12: The Chairman was concerned about the number and untidiness of the signs regularly displayed by the flower stall.  It was agreed that the matter be raised with Sandon Parish Council.

 

67 Matters for report (for information only)

Mr Keeler reported that there was a large water leak near the junction of Fitzwater Lane and Sporhams Lane.
