Minutes of the Meeting held on 22 May 2006 at 8.00pm in the Parish Office

Public Question Time

Three members of the public were present in connection with application 06/00331/FUL.  Public Question Time was deferred until after the first three items.

 

1 Election of Chairman

Cllr Keeler nominated Cllr Allen.  The nomination was seconded by Cllr Wood and agreed unanimously.

RESOLVED: that Cllr Allen be elected as Chairman of the Planning Committee for 2006-07.

 

2 Election of Vice-Chairman

Cllr Wood nominated Cllr Telling.  The nomination was seconded by Cllr Keeler and agreed unanimously.

RESOLVED: that Cllr Telling be elected as Vice-Chairman of the Planning Committee for 2006-07.

 

3 Co-option of Additional Members

The Committee agreed that it wished all three additional members to continue.  Mr Watts indicated that he was happy to continue to represent the Danbury Society.  Mr Alexander had indicated to Cllr Thomson that he was willing to remain a member.  Mr Chandler’s involvement was valued for his knowledge and experience but he had not been able to attend recently.

RESOLVED: that Mr Alexander, Mr Chandler and Mr Watts be re-appointed as members of the Planning Committee for a further year, and that a letter be sent to Mr Chandler to ascertain that he was willing to continue.

Note: Since the meeting Mr Chandler has indicated that he wishes to stand down due to other commitments.  A message of thanks for his past assistance will be sent.

 

4 Public Question Time

The members of the public present were invited to address the meeting at this point.  They explained their objections to the conservatory at 46 West Belvedere (which had been erected without planning approval).  These included the design and height of the roof, which were out of keeping with neighbouring properties, and the overlooking of 48 West Belvedere.  The neighbours had sent objections to CBC Town Planning.

 

5 Apologies for absence

Apologies were received and accepted from Mr Alexander, Cllr Berlyn and Mr Chandler.

 

6 Declarations of Interest

Members were reminded that they must declare any personal or prejudicial personal interests in any items of business on the meeting’s agenda.

Cllr Thomson declared a personal interest in the application at 46 West Belvedere by virtue of being acquainted with neighbours of the property who objected to the application and were present at the meeting.

 

7 Minutes

RESOLVED: that the minutes of the meeting held on 8th May 2006 be approved and signed as a correct record.

 

8 CBC Planning applications and decisions

Applications were considered and responses agreed.  At the appropriate time letters and verbal representations regarding the application at 46 West Belvedere (06/00331/FUL) were taken into account.

No planning decision notices had been received.

RESOLVED: that the responses to planning applications shown in Appendix A be submitted to Chelmsford Borough Council, and that none of the these applications need be referred to the local Ward Members.

 

9 Planning Appeal

05/01427/FUL Danecourt, Copt Hill: Extension to garage building for staff accommodation (Refused 13/10/05)

The applicant had submitted an appeal to the Planning Inspectorate against refusal of planning permission and the Parish Council had been invited to submit further comments to the Inspectorate.  The Committee agreed to respond by supporting CBC’s decision to refuse the application.

 

10 CBC Planning matters

a) CBC Planning Committee: Cllr Keeler had attended the meeting on behalf of the Council in relation to the application at Danbury Park Conference Centre which was reconsidered following a site visit.  He gave a brief report on proceedings.  The application had been approved with a number of conditions;

b) CBC Parish Councils’ Forum: The Assistant Clerk, Cllr Allen and Cllr Berlyn hoped to attend the meeting on the evening of Wednesday 24th May;

c) Planning applications – Site Notices: The letter from the CBC Customer Services Officer was discussed.  A response regarding an apparent change of practice was agreed.  Members would consider for the next meeting whether there were any ways in which the Parish Council could assist in publicising planning applications.

 

11 CPRE East of England: LDF Workshop

Members were reminded about the workshop “Local Development Frameworks – Getting the best for your community” to be held on Thursday 5 October 2006 at Huntingdon.  Cllr Keeler indicated that he would like to attend.

 

12 Danbury Planning Framework

The Chairman reported that the document was now with Derek Stebbing and he hoped to receive comments shortly.

 

13 Work to trees

a) Tree Applications: Applications for work to trees protected by a TPO were considered as shown in Appendix B.

RESOLVED: that CBC be informed that the Council did not wish to make any comments;

b) Decision notice: 06/05518/CAT 46 Main Road: The list of work to be carried out had been queried with the Tree Officer at CBC who confirmed that the felling of 26 Elms, 2 Pear trees and 1 Willow, mentioned in the decision notice but omitted from the application, had already been approved (04/05504/CAT).  It was understood that the trees being removed were small specimens in poor condition.  The trees were being felled to clear a temporary works entrance at the Main Road end of the site.  After construction of the new property a replanting scheme would be carried out in agreement with CBC.

RESOLVED: that the information be noted.

c) TPO 2006/26: 1 Ash tree at Skerries, Riffhams Lane: This new TPO was noted;

d) TPO 2005/49 St Joseph’s Nursing Home, Gay Bowers Road: This Order had been approved without variation on 8 May 2006.

 

14 Correspondence

All items were dealt with elsewhere on the agenda.

 

15 Enforcement

Fly-posting for Caravan Park: Further posters had been erected over the last weekend which were believed to relate to Waterside caravan park.  Paul Bohannan at CBC was taking enforcement action.

 

16 Matters for report (for information only)

No matters were raised.

 

17 Forthcoming meetings

Meetings are scheduled for 5th and 19th June; 3rd, 17th and 31st July 2006.

There are no meetings in August.

 

Business having been concluded, the Chairman closed the meeting at 9.40pm.

1 The size and bulk is out of keeping with the host building and neighbouring properties. The roofline is incongruous when taken with neighbouring properties, especially when lit up at night giving rise to significant light intrusion;
2 There are also overlooking difficulties into No 48 due to the elevation of the structure and slope of the ground;
3 Noise is also an issue emmanating from open windows.
