Minutes of the Meeting held on 24 April 2006 at 8.00pm in the Parish Office

Public Question Time

No members of the public were present.

 

268 Apologies for absence

Apologies were received and accepted from Cllr S Berlyn, Cllr G Gardiner, Mr R Chandler and Mr P Watts.

 

269 Declarations of Interest

Members were reminded that they must declare any personal or prejudicial personal interests in any items of business on the meeting’s agenda.

 

270 Minutes

The minutes of the meeting held on 3rd April 2006 were approved and signed as a correct record.  There were no matters arising.

 

271 CBC Planning applications and decisions

The Committee considered the applications received and agreed its comments.

RESOLVED: that the responses to planning applications shown in Appendix A be submitted to Chelmsford Borough Council.  No applications need be referred to the local Ward Members.

 

272 Planning decisions

The decisions received were noted.  With regard to the Committee’s concern that trees at 23 Nursery Lane (06/00064/FUL) be protected during construction work, members noted the following comment in the Case Officer’s report on the application: “The trees in the rear garden of No.23 Nursery Lane are conifers which have no public amenity value.  It is not necessary to ensure their special protection.”

RESOLVED: that the planning decisions shown in the Appendix B be noted.

 

273 CBC Planning Committee

The agenda for meeting held on Thursday 20th April was noted.  Cllr Gardiner had attended representing the Parish Council as the business included applications at Danbury Park Conference Centre (05/00997/FUL) and Poplars, Penny Royal Road (06/00336FUL and 06/00337/LBC).  The applications had been approved.

 

274 Danbury Planning Framework

The Chairman reported that the final draft of the Framework was ready to be seen by the Chairman of Council, after which it would be sent to Derek Stebbing at CBC for review and, hopefully, approval for publication.  

 

275 Trees

An application for work to trees protected by a TPO was considered.  TPOs 2005/67 (Bell Hill Wood) and 2006/05 (32 Runsell Lane) had been confirmed without modification.

RESOLVED: that the Committee wished to make no comments in respect of the application for work to trees at 1 Dingley Dell, as shown in Appendix C.

 

276 Licensing Act 2003 and CBC procedures

It was reported that the Essex Association of Local Councils (EALC) was actively pursuing the concerns of parish and other councils that they were not statutory consultees under the Act.  At least one authority did inform local councils of applications, and EALC was taking advice to determine whether this was legal before deciding on its next step. 

 

277 Correspondence

a) CBC Parish Councils’ Forum: The agenda for the next meeting (7pm on Wednesday 24th May in the Council Chamber) had been circulated.  The Chairman of Planning and the Assistant Clerk were hoping to attend.  Any other councillors wishing to attend were asked to inform the Parish Office so that numbers could be notified to CBC;

b) Airey Housing redevelopment in Mill Lane: The reply from Chelmer Housing Partnership regarding the allocation of the new houses was noted.  CBC was entitled to nominate the majority of the occupants, but CHP indicated that it was prepared to work with the Parish and Borough Councils to investigate the possibility of a local lettings policy.

RESOLVED: that CHP be approached regarding the appropriate way to take forward the proposal to establish a local lettings policy;

c) Cliftonville, Southwood Chase (06/00280/FUL): Mrs Harrison of Southwood Chase had copied to the Council her letter to the Development Manager at Town Planning expressing her disappointment at the granting of planning approval for a replacement dwelling at Cliftonville and her views on the adverse nature of other planning decisions in the Southwood Chase area.  Mrs Harrison had copied her letter to Cllr Ian Wright.  An acknowledgment of the letter would be sent.

 

278 Enforcement

a) Fly posting for caravan park: Photographs of the signs had been sent to Paul Bohannan at CBC, who had written to Waterside Holiday Park threatening prosecution it they continued to erect the advertisements.  He had requested feedback as to whether the signs are still appearing at weekends.  Members reported that the signs had not appeared on the last two weekends.

b) Road signs: Responses from ECC regarding the missing 40mph sign at the eastern edge of the village, the removal of Danbury from direction signs on the A12 and the removal of a 30mph sign at the Well Lane end of The Heights were noted.

 

279 Matters for report  No matters were raised.

 

280 Forthcoming meetings

Meetings are scheduled for 8th and 22nd May, 5th and 19th June 2006.

 

Business having been concluded, the Chairman closed the meeting at 9.20pm.
